1897 did carelessly and negligently fill up said natural water course and divert the water … and caused all of said water to flow over said lands of plaintiff described herein and by the means thereof did destroy the years …… thereon and converted a large quantity of said land in to ….. of the same in a complete mirebed and in consequence of said diversion and obstruction of said watercourse the plaintiffs has suffered great damage and injury to plaintiffs damage of one hundred dollars.
